Terms and Conditions

1 - DOMAIN OWNERSHIP

INFOGENE, Lda. is a company whose mission is to research, develop, manufacture, and market new tests and services for the early detection of cancer, using non-invasive methods. INFOGENE is a company with NIPC 507766393, and its registered office is located at IPN TECBIS ED. D, Rua Pedro Nunes, S/N, 3030-199 COIMBRA, PORTUGAL.

2 - SCOPE AND OBJECTIVES

These general terms and conditions apply to customers of INFOGENE’s products and services. By purchasing or acquiring goods/services available on the website, the user accepts these general terms and conditions.

INFOGENE reserves the right to modify these terms of use and the contract without prior notice. Any changes will be published on the INFOGENE website.

3 - INFORMATION ABOUT CONTENT

INFOGENE reserves the right to modify the information and offers presented on services, products, promotions, prices, commercial conditions, and services at any time.

The use of links or the company logo for commercial purposes without prior authorization from INFOGENE is strictly prohibited.

4 - INTELLECTUAL AND INDUSTRIAL PROPERTY

All texts, comments, documents, illustrations, artworks, and images reproduced or represented on the website: www.infogene.com are strictly protected under copyright laws and intellectual property rights worldwide. Accordingly, and by the Portuguese Industrial Property Code, only private use is authorized, unless contrary provisions, including more restrictive provisions included in said code, are presented. Any total or partial reproduction or representation of the INFOGENE website or any part of the elements included therein is strictly prohibited.

5 - USER RIGHTS AND RESPONSIBILITIES

5.1 - USERS RESPONSIBILITIES

The User must comply with these general conditions and terms, respect them, and commit to the following obligations, in addition to those set out in Portuguese Law:

  • I. Do not disclose or store your password in restricted parts of the website to prevent third parties from accessing your account;
  • II. Do not use false identities;
  • III. Provide accurate personal data and correct addresses, enabling INFOGENE to process orders properly;
  • IV. Do not provide false information or data;
  • V. Pay the amount indicated for the goods or services you intend to purchase;
  • V. Respect copyright and intellectual property;

The User is responsible for the accuracy of the data communicated to INFOGENE and undertakes to communicate any changes to the data.

5.2 - USER RIGHTS

The User has the following rights, in addition to those granted by Portuguese Law:

  • I. Receive the purchased product in good conditions;
  • II. Claim defective products;
  • III. Claim products that do not conform to those presented on the website and that were purchased;
  • IV. Protection of personal data transmitted to INFOGENE.

6 - DATA PROTECTION

INFOGENE undertakes to maintain secrecy and confidentiality of the data of members and users of the website, in accordance with Portuguese state law.

7 - RETURNS

I. RIGHT TO WITHDRAW OR CANCEL

Under the terms of Portuguese Decree-Law No. 24/2014, dated February 14, which applies to contracts concluded remotely, you have the right to freely terminate a new contract (right to withdrawal or cancel), without giving a reason, within 14 calendar days from the date of execution or the date of receipt. To exercise this right, simply inform us of your decision, preferably by email or alternatively by letter or telephone.

II. COOLING-OF PERIOD

The cooling-off period ends 14 consecutive days after the date of product delivery. If the deadline does not fall on a working day, it is extended until the next working day. You must unequivocally communicate your decision to cancel the purchase. Merely returning the goods is not sufficient. You can use the Free Resolution Form template below, but this is not mandatory. Unused good must be returned within 14 days from the date on which you inform us of your intent to cancel the purchase.

III. CONDITION OF PRODUCTS TO BE RETURNED

The products to be returned must be in perfect condition, complete, with all their components, accessories, labels, and instruction manual, and properly wrapped in the original packaging, with the respective warranty seals and/or protective plastic, and without signs of actual use. In accordance with the exceptions provided for in paragraph e) of article 17 of the Portuguese Decree-Law no. 24/2014, dated February 14, articles that show signs of use, such as the opening of the device's internal packaging for health protection or hygiene reasons, are not eligible for return unless they are received defective by the customer.

IV. COSTS OF RETURNING GOODS

The transport costs for returning, replacing, or exchanging items are the sole responsibility of the customer, except for defective items for which INFOGENE will arrange collection. It is recommended that the item be sent with registration or acknowledgment of receipt and insurance with the carrier for the value of the products to protect against possible loss or damage.

V. ADDRESS FOR PRODUCT RETURNS

We kindly request that items to be returned or exchanged be sent to INFOGENE, indicating the order number and customer name, to the following address: IPN TECBIS Ed. D, Rua Pedro Nunes, S/N, 3030-199 Coimbra.

VI. REIMBURSEMENT

Upon receiving the items and conducting necessary checks as outlined in point III, we will process the refund for the value of the product(s) through a bank transfer to a NIB/IBAN provided by the customer within a maximum period of 10 days. This period is suspended until we receive of a Credit Note signed by the customer.

8 - PAYMENT METHODS

The validation of any requested service assumes that the user is aware of and accepts all general terms and conditions.

For payments by bank transfer or credit cards, any product will only be shipped, the provision of service will be confirmed, or invoices/receipts will be issued after payment confirmation.
